New Year, New Spousal Support Tax Effects

One of the provisions of the 2018 Tax Law makes a big difference to many people who are getting a divorce, particularly those who anticipate paying spousal support, also known as maintenance or alimony. Under the new tax law, if your settlement agreement or Judgment of Divorce containing a provision for spousal support is signed after Dec. 31, 2018 the spousal support/maintenance/alimony will not be tax deductible to the payor.

This change does NOT change the deductibility of any previous agreement or court order; if your settlement agreement or Order is dated on Dec. 31, 2018 or prior the payments will still be deductible even after the new law takes effect.
